The property owner is. Under New York City rules the adjacent owner is responsible for installing and maintaining the public sidewalk in front of the property, even though the city owns the land. A defect can become your violation and your liability, which is why keeping the sidewalk sound is worth doing before the city flags it.

The defective sidewalk sections have to be rebuilt to the DOT specification and the correction confirmed. A cosmetic patch that is not to standard will not clear it. We repair or replace the flagged sections to spec so the work counts toward removing the violation from your property record.

It comes down to how many flags are defective, whether it is a repair or a full frontage replacement, the condition of the base underneath, and whether tree roots or a curb are involved.
